1.⁠ ⁠Acceptance of Agreement
By purchasing a 1-UP subscription via our authorized payment processor, Stripe, you agree to be bound by these terms. This document constitutes a legally binding agreement between you and Dezerland Park Orlando.

2.⁠ ⁠Subscription Service and Limitations
The 1-UP subscription provides a TimeCard for unlimited daily arcade play. Dezerland Park Orlando imposes no blackout dates and no time restrictions. The system enforces the following operational limitations automatically:

TimeCards do not accrue tickets.

TimeCards are invalid for prize games and attractions.

The system imposes a mandatory 60-second cooldown period between each use.

You must adhere strictly to the following rule:

You must not share TimeCards with third parties.

3.⁠ ⁠Recurring Billing, Fees, and Payment
All transactions process through Stripe. By enrolling, you authorize Dezerland Park Orlando, via Stripe, to charge your designated payment method on a recurring basis. You agree to pay all base costs, applicable taxes, and transaction fees.

Monthly Subscription: The base cost is $39.95 plus applicable taxes and a recurring $1.37 transaction fee. The system bills this total amount every 30 days.

Annual Subscription: The base cost is $359.40 plus applicable taxes and a recurring $11.73 transaction fee. The system bills this total amount every 360 days.

4.⁠ ⁠Optional Ticket Add-On
Subscribers may elect to purchase a recurring allotment of 300 tickets per month. You must maintain an active 1-UP subscription to receive these tickets.

Monthly Add-On: The cost is $4.95 plus applicable taxes, billed every 30 days.

Annual Add-On: The cost is $49.95 plus applicable taxes, billed every 360 days.

5.⁠ ⁠Term, Cancellation, and Non-Refundable Policy
You may cancel your subscription at any time to prevent future billing. Dezerland Park Orlando provides no refunds and issues no credits for partial billing periods. Upon cancellation, your access remains active until the current 30-day or 360-day billing cycle concludes. Dezerland Park Orlando reserves the right to terminate this agreement immediately upon your breach of these terms.

6.⁠ ⁠Third-Party Payment Processor
Stripe manages all subscription payments. Dezerland Park Orlando assumes no liability for errors or disruptions originating from Stripe. Your financial data remains subject exclusively to the privacy policy and terms of service of Stripe.

7.⁠ ⁠Modification of Terms
Dezerland Park Orlando reserves the right to modify these terms. We will provide notice of material changes through the email address associated with your account. Continued use of the subscription constitutes acceptance of the modified terms.

8.⁠ ⁠Limitation of Liability
Dezerland Park Orlando provides the 1-UP subscription “as is” and without warranties of any kind. We assume no liability for service interruptions, machine malfunctions, or damages arising from your use of the arcade.

9.⁠ ⁠Indemnification
You agree to indemnify and to hold harmless Dezerland Park Orlando from any claims, damages, or expenses resulting from your violation of these terms.

10.⁠ ⁠Governing Law and Dispute Resolution
The laws of the State of Florida govern this agreement. You must resolve any disputes exclusively in the state or federal courts located within Orange County, Florida.
